The petitioner seeks bail in a case registered for the offence under Sections 376, 420, 448, 504 and 506 of the Indian Penal Code.
The informant, who is a scheduled caste lady, is subjected to rape and she has been threatened to kill by the petitioner if she would be whispering anything to anyone. Earlier the prayer for bail of the petitioner had been refused by a co-ordinate Bench of this Court on merit vide order dated 18.06.2020 passed in Cr. Misc. No. 9665 of 2020. Now, the petitioner has renewed his prayer for bail. This Court while considering the prayer for bail of
Patna High Court CR. MISC. No.27473 of 2022(4) dt.12-10-2022 2/2 this petitioner on earlier occasion called for a report regarding the stage of the trial which has accordingly, been received and reveals that the trial of the case is at advance stage of its conclusion and is likely to be concluded soon. In view of the report received from the court below, this Court, without going into the merits of the case, is not inclined to grant the privilege of bail to the petitioner at this stage. Accordingly, the prayer for bail of this petitioner is rejected.
However, learned trial court is directed to expedite the conclusion of the trial.
