2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 09.11.2023 passed in Cr. Misc. No. 72687 of 2023.

3. The petitioner seeks regular bail in a case registered for the offence under Section 395 of the Indian Penal Code.

4. As per the materials available on record it appears that the petitioner was dealing in looted gold. He is in jail since 19.10.2022 and has clean antecedent.

5. It has been argued by the learned counsel for the petitioner that some co-accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 28.06.2023 passed in Cr. Misc. No. 20819 of 2023 and vide

Patna High Court CR. MISC. No.29373 of 2024(2) dt.21-06-2024 2/2 order dated 25.05.2023 passed in Cr. Misc. No. 27196 of 2023.

6. Considering the period of custody and the clean antecedent, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari/concerned Court below in connection with Chakiya P.S. Case No. 213 of 2022 subject to conditions that:- 7(i). The petitioner will mark his attendance at the Keshariya Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

7(ii). The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
