This application has been filed on behalf of the petitioners for Modification of order dated 08.05.2017 passed in Criminal Miscellaneous No. 13536 of 2017.
Learned counsel appearing on behalf of the petitioners submits that vide order dated 08.05.2017 passed in Cr. Misc. No. 13536 of 2017, the petitioners were ordered to be released on bail in the event of their arrest or surrender before the court below within the period of four weeks on furnishing the bail bond of Rs. 10,000/- (Ten thousand) each with two
Patna High Court Cr.Misc. No.17604 of 2018(2) dt.02-05-2018 2/3 sureties of like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in Bettiah (M) P.S. Case No. 433 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C with observation that if the petitioners will show the receipt of depositing Rs. 45,000/- to the District Agriculture Officer, Bettiah within three months their bail will be confirmed failing which the trial court will cancel their bail bonds. Further submission is that all the aforesaid three petitioners, each, also deposited Rs. 45,000/- in the office of District Agriculture Officer, Bettiah within three months for furnishing the bail bond, but trial court has taken note of period of four months from the passing of the order on 08.05.
2017 passed in Criminal Miscellaneous No. 13536 of 2017. In that view of the matter, the learned counsel for the petitioners prays for extending the period of submitting the receipt of depositing Rs. 45,000/- in the office of District Agriculture Officer, Bettiah for further four weeks. In view of the submissions of the learned counsel for the petitioners, the period of showing the receipt of depositing Rs. 45,000/- in the office of District Agriculture Officer, Bettiah is further extended for six weeks from today. Accordingly, the modification application is allowed and the order dated 08.05.
Patna High Court Cr.Misc. No.17604 of 2018(2) dt.02-05-2018 3/3 Miscellaneous No. 13536 of 2017 is modified to the above extent.
