The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 544 of 2016 instituted for the offence under Section(s) 394/395/412 of the Indian Penal Code. Learned counsel for petitioner has submitted that petitioner is not named in the written report. No incriminating article has been recovered from possession of this petitioner. No TIP has been held. The name of this petitioner has come during investigation in confessional statements of co-accused, namely, Suraj Kumar and Prince Kumar Singh.
Learned counsel for petitioner has further submitted that other co-accused persons, namely, Suraj Kumar and Prince
Patna High Court CR. MISC. No.25485 of 2019(2) dt.24-04-2019 2/2 Kumar Singh have already been granted bail by co-ordinate Bench of this Court by order dated 08.12.2016 passed in Criminal Miscellaneous No. 52127 of 2016 and order dated 17.04.2017 passed in Criminal Miscellaneous No. 11670 of 2017 respectively.
Petitioner is in custody since 16.04.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I, Sitamarhi in connection with Sitamarhi P.S. Case No. 544 of 2016, Sessions Trial no. 279 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
