2. The petitioner seeks bail in connection with Barachatti P.S. Case No. 425 of 2021 instituted for the offences punishable under Sections 304(B) and 120(B) of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with other co-accused have committed murder of the informant's sister and burnt the deceased for the disappearance of the evidence.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is the husband of the deceased and he has falsely been implicated in this case merely on suspicion. During course of investigation, no any cogent evidence has found to show the deceased was killed by

Patna High Court CR. MISC. No.27215 of 2023(5) dt.01-03-2024 2/2 the petitioner. There is general and omnibus allegation against the petitioner. He has got no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. From perusal of the F.I.R., case diary and impugned order dated 27.01.2023, it appears that F.I.R. registered under Sections 304(B) and 120(B) of the I.P.C. against the seven accused persons including the petitioner on the basis of written report of informant Mahesh Kumar. In the entire case diary, no statement regarding demand of dowry and no eye witness to support the case of prosecution. Petitioner is in custody since 25.06.2023, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, District-Gaya in connection with Barachatti P.S. Case No. 425 of 2021.
