JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-01-2022 Heard Mr. Ravi Ranjan, learned counsel for the petitioner and Mr. Dilip Kumar No.1, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Excise Case No. 160/2021 arising out of PR No. 112/2021 registered for the offence punishable under Sections 30(a)/32(3) of Bihar Prohibition & Excise Act.
The police, allegedly, recovered 36 litres of illicit liquor from the scooty being driven by the petitioner. Learned counsel for the petitioner submits that the petitioner is not the owner of the said scooty and he was not aware about the liquor being kept therein.
Learned counsel for the petitioner further submits that petitioner is in custody since 24.03.2021 and charge-sheet has

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 24.03.2021, chargesheet has been submitted and there is no likelihood that the petitioner shall abscond or tamper with the evidences, if he is released, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, SHIV NARESH SINGH be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Excise Case No. 160/2021 arising out of PR No. 112/2021.
