The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379 of the Indian Penal Code.

The prosecution case is that in the background of a dispute with regard to the 'gair majrua' land petitioner no.1 Jaynandan Singh assaulted with 'khanti' on the chest of the informant whereas co-accused Mausam Kumar aimed pistol on him and petitioner no.2 Sanehi Singh assaulted with 'lathi' caused injury on the left wrist and arm of the informant. It is further alleged that co-accused Mausam Kumar snatched gold chain from the informant.

It is submitted by learned counsel for the petitioners that the injury report does not suggest any injury on the chest

Patna High Court Cr.Misc. No.57023 of 2015 (2) dt.17-12-2015 2/2 whereas it is alleged against petitioner no.1 to have caused injury on the chest of the informant. It is further submitted that petitioner no.2 alleged to have caused injury on the left wrist and hand though injury has been found on the right wrist. The injury has been found to be simple in nature, caused by hard and blunt substance, though with regard to some of the injuries opinion has been kept reserved. The petitioners being the agnate of the informant have been roped in the present case. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Nawada in connection with Nardiganj P.S. Case No.84/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
