Petitioner is in custody in connection with Hayaghat P.S.Case No. 88 of 2019 for the offence under Section 364A, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

Allegation against this petitioner is that he was involved in kidnapping the informant. Learned counsel for the petitioner submits that from the version of the informant itself, it is evident that he has come to Darbhanga and stayed in a Hotel on his own sweet-will. In such situation, the allegation that he was kidnapped by the petitioner and others is absurd. Petitioner

Considering the submission that petitioner has no criminal antecedent and he has remained in custody since 24.12.2019, the Court is inclined to grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Darbhanga in connection with Hayaghat P.S.Case No.88 of 2019.

The petitioner shall deposit Rs.50,000/- cash in the court below and the amount of Rs.50,000/- deposited by the petitioner shall abide by the final outcome of the pending criminal case.
