2. The petitioner seeks regular bail in connection with Buxar (Town) P.S. Case No. 208 of 2023 registered for the offence under Sections 21, 22 and 27 of the N.D.P.S. Act.
3. As per allegation in the FIR, it is a case of recovery total of 6.97 gram of Heroine in 20 sachets from the possession of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner is in custody since 18.04.2023.
5. However, learned APP for the State vehemently opposed the prayer for regular bail.
6. On perusal of the FIR, seizure list and impugned
Patna High Court CR. MISC. No.30492 of 2024(2) dt.24-04-2024 2/2 order dated 15.03.2024, it appears that heroine recovered from the possession of the petitioner is above the small quantity and the trial is at advance stage, therefore, I am not inclined to grant bail the petitioner.
7. Accordingly, the prayer for bail is hereby rejected.
8. However, the learned trial Court is directed to conclude the trial within a period of six months from the date of receipt of a copy of this order and if the trial is not concluded within the stipulated period, then the petitioner may renew his prayer for bail before the trial Court and the trial Court shall grant bail to the petitioner.
