JUSTICE SANJAY PRIYA ORAL ORDER 3/ 09-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Chhatauni P.S. Case No.274 of 2015 instituted for the offence under Section(s) 304-B, 201/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Motihari, East Champran. Petitioner is husband of the deceased. There is allegation in the written report that altercation had taken place between this petitioner and his wife for purchasing of clothes on 16.11.2015. Thereafter, this petitioner and two others unknown persons committed murder of the informant's daughter. It is also alleged that this petitioner after marriage used to demand dowry from the informant. It is also alleged that dead body was disposed

Patna High Court Cr.Misc. No.9908 of 2018 (3) dt.09-03-2018 2/2 off without giving information to the family members of the deceased including the informant.

Case diary has been received. Learned APP has submitted that police has already submitted charge-sheet against other accused for the offence under Section(s) 304-B, 201/34 Indian Penal Code.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
