JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-09-2016 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no. 1, Nazma Khatoon. Permission is accorded.

Accordingly, the application in respect to petitioner no.1 is dismissed, as withdrawn.

Heard learned counsel for the petitioner nos. 2 and 3 and the learned A.P.P. for the State.

The petitioner nos. 2 and 3 apprehend their arrest in connection with Manjhi P.S. Case No. 43 of 2016 registered under Section 304B/34 of the Indian Penal Code.

The accusation is of torturing the daughter of the

Patna High Court Cr.Misc. No.36549 of 2016 (2) dt.17-09-2016 2/2 informant due to non-fulfillment of demand of dowry and also killing her by setting on fire by her in-laws. Learned counsel appearing on behalf of the petitioners submits that petitioner nos. 2 and 3 are married and unmarried sister-in-laws of the deceased, daughter of informant and both have been falsely implicated in this case only with ulterior motive. It is further submitted that there is no specific overt act has been attributed against the petitioner nos. 2 to 3. Having considered the facts and circumstances of the case, let the above named petitioners no.2 and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., 5th, Saran at Chapra in connection with Manjhi P.S. Case No. 43 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
