2. The petitioners apprehend their arrest in a case registered for the offence under Sections 406 & 420 of the Indian Penal Code.

3. In this case, a supplementary affidavit has been filed on behalf of petitioners and in paragraph - 3 of the same, it is stated that petitioners are ready to pay agreement amount i.e. Rs. 1,51,000/- (Rupees one lac fifty one thousand) in installments to the informant.

4. However, learned counsel for opposite party no. 2 disputes the admitted amount.

5. Considering the aforesaid facts and circumstances,

Patna High Court CR. MISC. No.27775 of 2023(3) dt.31-07-2023 2/2 in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Bhagalpur in connection with Kahalgaon P.S. Case No. 77 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, in the light of following terms and conditions:

A. At the time of furnishing bail-bond Rs.

50,000/- (Rupees fifty thousand) shall be deposited through Bank Draft.

B. Rest amount i.e. Rs. 1,01,000/- (Rupees one lac one thousand) in four installment at the rate of 25,250/- per installment within a period of six months from the date of furnishing bail-bond. C. If petitioner fails to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bond of the petitioner.

6. It is made clear that without going into the merit of the case, the aforesaid order has been passed only for the purpose of grant of bail.
