JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-11-2020 Heard Mr. Sanjay Kumar, learned counsel for the petitioners, Mr. Sanjeev Kumar Srivastava for the informant and Ms. Indu Kumari Srivastava, learned APP for the State.

The petitioners seek bail in connection with Dumraon P.S. Case No. 96 of 2020 dated 10.03.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 302, 504 and 307 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that approximately 17 persons have been named in the FIR whereas 10-20 persons have been unnamed. All of them are alleged to have assaulted the

Patna High Court CR. MISC. No.25279 of 2020(3) dt.02-11-2020 2/3 wife of the informant leading to her death. The specific act of accusation is against six persons including the petitioners and one Dinesh Yadav. Aforesaid Dinesh Yadav has been granted bail by a Bench of this Court vide Cr. Misc. 25516 of 2020.

The petitioners are said to be in custody since 11.03.2020.

Apart from this, it has been submitted that no reason has been assigned in the FIR regarding the cause of occurrence.

Considering the aforestated facts as also the period of custody of the petitioners and their parity with other accused person who has been granted bail by a Bench of this Court, the petitioners are also directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 96 of 2020. However, the petitioners are directed to participate in the trial proceedings and their absence from such proceedings on two consecutive occasions without any plausible reason or seeking permission from the trial court, the bail granted to the petitioners would be liable to be cancelled. In that event the trial court
