Counsel for the State is, however, present.

The writ application was filed for staying the departmental proceeding which was initiated against the petitioner on certain charges. While the petitioner was posted as Executive Engineer N.R.E.P, Goh Block, Aurangabad he was made an accused of a trap case while accepting bribe. The prayer in this writ application is to stay the departmental proceeding till conclusion of the criminal trial.

Learned counsel for the State has rightly points

Patna High Court CWJC No.15468 of 2007 (2) dt.28-04-2015 2 / 2 out that with the passage of time the writ application appears to have become infructuous.

Be that as it may, since nobody appears on behalf of the petitioner to press this application, this Court is constrained to dismiss the application for non prosecution. I order accordingly.
