JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioners is that they have fraudulently sold the land of the informant to one Anup Kumar. It is submitted on behalf of the petitioners that petitioner no. 1 is a lady and has got no criminal antecedent. As per prosecution case, petitioner no. 1 is said to have executed the sale deed and petitioner no. 2 is the witness to the sale deed. It is further submitted that it is a family dispute between the parties and the allegation relates to civil dispute.

On behalf of the State and the informant, it is submitted that the petitioners are named in the F.I.R. and fraud has been committed by them.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.56891 of 2015 (2) dt.13-01-2016 2 / 2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwant Nagar P.S. Case no. 170 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
