JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Barhara P.S. Case No. 381 of 2015 for the offences instituted under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.

The petitioner is alleged to have embezzled the loan amount along with the interest by playing fraud, which was taken from the Bank in the name of purchasing a vehicle. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He has

Patna High Court Cr.Misc. No.44749 of 2016 (3) dt.24-11-2016 2/2 falsely been implicated in the present case. In course of investigation, in para-28 of the case diary, Supervising Officer has found the case to be doubtful and has recommended for initiating prosecution against the informant under Section 182 and 211 of the Cr.P.C.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Barhara P.S. Case No. 381 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
