JUSTICE SANJAY PRIYA ORAL ORDER 5/ 08-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Sadar P.S. Case No.489 of 2018 instituted for the offence under Section(s) 302,120-B Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that there is no eye witness in the case. The informant has alleged that unknown person has fired on brother of the informant. He has raised suspicion against the petitioner in the written report that 6-7 months back the deceased brother had told that this petitioner, who is Mukhiya, had conspired to kill him.
Counsel for the informant as well as learned APP has referred to the case diary and submitted that witnesses have said
Patna High Court CR. MISC. No.24063 of 2019(5) dt.08-07-2019 2/2 that this petitioner had conspired to kill brother of the informant. There is also confessional statement of the petitioner recorded by the police.
In this manner, there is no allegation of any specific overt act against the petitioner.
Petitioner is in custody since 01.02.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga at Laheriasarai, in connection with Sadar P.S. Case No.489 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
