JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Sri Nawal Kishore Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is husband of the daughter of the informant, has prayed for grant of anticipatory bail in Complaint Case no.1873/2014, Tr.No.1849/2016, registered for the offence under Sections 323, 498(A)/ 34 of the Indian Penal Code.
It was submitted by learned counsel for the petitioner that the petitioner is still ready to keep his wife with full honour and dignity. However, on going through the impugned order, it is evident that before the court below the victim had appeared and was ready to go with the petitioner, but the petitioner
Patna High Court Cr.Misc. No.47977 of 2016 (2) dt.24-11-2016 2/2 avoided to take her with him on one pretext or the other. Keeping in view the fact that the petitioner is still ready to settle the dispute, the Court is of the opinion that such stand may be taken before the court below.
The petition stands disposed of with indication that if within a period of six weeks from today the petitioner appears before the court below and makes a prayer for regular bail, the learned court below may examine the same and pass appropriate order in accordance with law preferably on the same day.
