Mr Rishi Raj Sinha, SC XIX ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 05-08-2022 Heard learned counsel for the petitioners and the respondents through Virtual Mode.
Learned counsel for the petitioners submits that the benefits under Assured Career Progression (for brevity, ACP) Scheme, which was granted to the petitioners by order dated 24.10.2017 (Annexure P4) issued by the Director, Department of Animal Husbandry, has subsequently been stayed by the
Patna High Court CWJC No.7388 of 2022(2) dt.05-08-2022 2/2 Director, Department of Animal Husbandry under order dated 29.12.2017.
The petitioners have represented before the Director, Department of Animal Husbandry on 27.08.2018 by Annexure P-8. However, no final decision has been taken on the petitioners' grievance with reference to their entitlement for benefits under ACP and the stay order is being continued without taking a final decision in respect of their entitlement. It is submitted that if the respondents consider their claim, then there is likelihood that the authorities would be convinced of the petitioners' entitlement for the reasons indicated in their representation.
In view of the limited submission made regarding pendency of the petitioners' claim (Annexure P-8), this writ petition need not be kept pending for any adjudication. The same is, accordingly, disposed of.
Respondent No 4 should take a decision on the petitioners' representation dated 27.08.2018 (Annexure P-8) without any delay.
