JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Maner P.S. Casem No. 143 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact, informant side wanted to grab the land of the petitioner and they brutally assaulted petitioner's side causing injury as contained in Annexure-3. There is admitted land dispute between the parties for which there is case and counter case. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation of firing against this petitioner causing injury to Babita Devi.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
