Petitioner is in custody in connection with Kazi Mohammadpur P.S. Case No. 544 of 2018 for the offence under sections 302, 201, 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 10.1.2019.

Referring to the prosecution case, she submits that the allegation against this petitioner is that he has invited the victim to celebrate X-mas (Baradin). Later his dead body was found near Maripur railway track.

Learned counsel with reference to inquest report submits that no ante-mortem injuries were found to connect this

Petitioner is in custody since 10.1.2019.

Since three months has expired,the investigation must have been completed in the instant case.

Considering the facts and circumstances discussed hereinabove, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-I cum Additional Chief Judicial Magistrate-1, East Muzaffarpur, in connection with Kazi Mohammadpur P.S. Case No. 544 of 2018.
