JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks bail in connection with Karai Pursurai P.S. Case No. 117 of 2018 registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act and later on Section 302 IPC was added.

As per FIR there is allegation that father of the informant was taken by the petitioner and one Jai Mal Paswan @ Pandit Ji and on way they shot at his father and he was taken to hospital.

Submission of learned counsel for the petitioner is that the statement of the deceased was recorded at hospital in which he has stated that Jai Mal Paswan @ Pandit Ji shot fire at him and petitioner is in custody for about six months.

No.24285 of 2019(3) dt.21-05-2019 2/2 Heard learned APP also, who has opposed the prayer for bail stating that it is the petitioner who also conspired with other accused in causing the death of the deceased. In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa in the district of Nalanda, in connection with Karai Parsurai P.S.Case No. 117 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
