The petitioner is in custody since 24.12.2018 in connection with Udwant Nagar P.S. Case No. 483 of 2018 for the offence registered under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that from a plain reading of the first information report, it appears that no specific role has been attributed to the present petitioner and it is the other accused persons who is said to have fired and not the present petitioner. It is further submitted that similarly situated co-accused persons namely, Bijendra Kumar Singh @ Bijendra Singh has since been extended the privilege of bail vide order dated 26.03.2019 passed in Cr. Misc. No. 16659 of
Patna High Court CR. MISC. No. 24892 of 2019(2) dt.18-04-2019 2/2 2019.
Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 483 of 2018.
Learned counsel for the informant submits that, till date, the case has not been committed to the court of sessions and, therefore, some direction may be issued. Let the concerned court, where the case is pending, take necessary steps towards commitment of the case, so that the matter may be sent up for trial.
