JUSTICE SANJAY PRIYA ORAL ORDER 08-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Paraiya P.S. Case No. 10 of 2017 instituted for the offence under Sections 302/34 of the Indian Penal Code.
In the written report there is specific allegation against this petitioner and three other accused persons of making firing on the son of the informant, on account of which he died. Case diary has been received and the post mortem report is available in the case diary. As per post mortem report, the Doctor has found firearm injuries on the person of the deceased. Besides firearm injury, other injuries were also found caused by hard and blunt object. All the injuries were on vital part of the deceased.
Patna High Court Cr.Misc. No.47216 of 2017 (3) dt.08-11-2017 2/2 Learned counsel for the informant has submitted that one of the co-accused in his confessional statement has levelled specific allegation against co-accused Bijali Paswan of firing on the son of the informant.
Learned A.P.P. has appeared and submitted that several witnesses have supported the case and levelled specific allegation against this petitioner in the case diary. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
