JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Kishanganj P.S. Case No. 453 of 2016 for an offence under sections 370, 370(A) of the Indian Penal Code and 5 of Human Trafficking Prevention Rules, 2008.

The allegation in the instant case is that the petitioner was involved in child trafficking.

Counsel for the petitioner has drawn attention of this court to the Annexure-2 filed by the father of the child who is supposed to be subject matter of trafficking by the petitioner. From perusal of Annexure-2, it appears that father of the child has stated that he has handed over his both sons in

Patna High Court Cr.Misc. No.39810 of 2017 (3) dt.18-10-2017 2/2 connection with getting education in Madrsa in U.P. and in that view of the matter he submits that the petitioner deserves for grant of anticipatory. He also submits that he is a man of clean antecedent as per statement on affidavit in para-3 of the petition. Considering the aforesaid circumstances, let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 453 of 2016, subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
