JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 380 of the Indian Penal Code.
On theft of mobile, laptop and cash of Rs.
7,000/- from the house of the informant the F.I.R was lodged against unknown. Subsequently the stolen mobile was recovered from one Saurav Kumar who claimed to have purchased it from the petitioner.
It is submitted by learned counsel for the petitioner that petitioner purchased the alleged mobile from one mobile dealer shop namely Sai Smart John. The petitioner was not aware about the mobile being stolen one.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.403 of 2016 (2) dt.07-01-2016 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Kankarbagh P.S. Case No. 364 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Patna. With the observations above, the application stands disposed off.
