The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. Prosecution case in brief is that on 06.12.2022, all the accused persons got the two sale deeds executed in favour of one Vinay Kumar Singh with respect to 43.50 decimals and 22 decimals of land respectively by committing forgery in collusion with the employees of Registry Office. It is further alleged that all the accused persons by giving threat to kill took the signature of informant and his impression on several stamp papers and fraudulently in collusion with Vinay Kumar Singh and the employees of Registry Office got the forged sale deed

Patna High Court CR. MISC. No.27118 of 2023(2) dt.07-07-2023 2/2 executed from the informant without giving any single money. It is submitted that petitioner has been falsely implicated in this case. Petitioner is neither purchaser, identifier nor the beneficiary. Informant had executed the sale deed after receiving the consideration money in presence of Registry Office and put his signature, so it cannot be said that informant did not appear before the Registry Office. Lastly, it is submitted that the matter relates to civil dispute.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Vaishali in connection with Mahua P.S. Case No. 802 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
