2. The petitioner seeks bail in connection with Surajgarha P.S. Case No. 291 of 2024 registered for the offence under Section 80(2), 3(5) of the BNS.
3. As per the prosecution case, the petitioner is the husband of the deceased, who is alleged to have killed the deceased.
4. The petitioner is in custody since 14.10.2024.
5. Learned counsel for the petitioner submits that the petitioner and the deceased had got married as per their wishes and the deceased has committed suicide. In support of

No.26275 of 2025(3) dt.06-08-2025 2/3 the same, learned senior counsel for the petitioner has taken this Court to paragraph 37 of the case diary and other materials available in the case diary. He further submits that the petitioner had informed the prosecution about the suicide committed by his wife. He further submits that the petitioner was arrested from his house.
6. Learned counsel for the informant Shri Sanjay Kr. Pandey has vehemently opposed the application of the petitioner and has submitted that the deceased was assaulted by the accused persons and was killed.
7. I have gone through the records of the case. In paragraph 3 of the case diary, it has come that the police got an information that the deceased has committed suicide and therefore they went to the place of occurrence where the dead body of the deceased was found. Further some of the witnesses have also supported the fact of love marriage between the petitioner and the deceased.
8. So far as the allegation of assault and torture is concerned, the same is falsified by the post-mortem report in which no anti-mortem injury has been found on the body of the deceased.
9. Considering the aforesaid facts, this application
Patna High Court CR. MISC. No.26275 of 2025(3) dt.06-08-2025 3/3 is allowed.
10. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Lakhisarai/concerned Court below in connection with Surajgarha P.S. Case No. 291 of 2024.
11. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
