The petitioner apprehends his arrest in Garkha P.S. Case No. 123/2014 registered under Section 307 and other sections of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant with Farsa on his head. It is submitted that the injury found on the person of the informant is simple in nature. The occurrence took place due to land dispute. Other accused persons have been granted anticipatory bail vide order passed in Cr. Misc. No. 39641/2016.

Considering the facts that the occurrence took place due to land dispute and on account of the assault made by the petitioner simple injury is caused to the informant, the above named petitioner, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.55574 of 2016 (2) dt.11-01-2017 2/2 learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Garakha P.S. Case No. 123/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
