Petitioner apprehends arrest in connection with Khgaria (Chitragupta Nagar) P.S. Case No.563 of 2017 registered for the offences under Sections 304, 120(B) and 34 of the Indian Penal Code.

It has been submitted that the petitioner is a private doctor practicing at Nursing Homes where an occurrence allegedly took place. The allegation of death of a pregnant lady took place in Sadar Hospital, Khagaria whereas the petitioner is practicing at different place. The other co-accused with specific allegation have been allowed anticipatory bail in Cr.Misc.No.55953 of 2017, Cr.Misc.No.4744 of 2018 and

Patna High Court Cr.Misc. No.24915 of 2018 (2) dt.04-05-2018 Cr.Misc.No.6284 of 2018. The case of this petitioner also stands on similar footing.

The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner, in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the likewise amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No.563 of 2017, G.R. No.2395 of 2017, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
