The petitioner is in custody since 19.02.2019 in connection with Narpatganj (Basmatiya) P.S. Case No. 103 of 2019 for the offence registered under Sections 413 and 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the alleged recovery was not from his conscious possession, as the motorcycle was recovered from bamboo clumps with which the petitioner has nothing to do and the other motorcycle which is alleged to have been recovered from the possession of the petitioner was, in fact, recovered from the front of the house of the petitioner and, therefore, he cannot be held responsible for

It is further submitted that the petitioner is willing to cooperate in any further investigation and shall appear as and when required during the course of the trial. Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj (Basmatiya) P.S. Case No. 103 of 2019.
