This application, for grant of anticipatory bail, arises out of Complaint Case No. 809C/2013, disclosing offences under Sections 323, 341, 379 and 313/34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 13.10.2017 passed in Cr. Misc. No. 48120/2017.
Considering the facts aforesaid, this application is
Patna High Court Cr.Misc. No.48874 of 2017 (2) dt.17-11-2017 2/2 allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran in connection with Complaint Case No. 809C/2013, subject to the condition laid down under Section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
