1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Kateya Police Station Case No. 487 of 2024, disclosing offences under Sections 126(2) ,115(2), 118(1), 109(1), 74, 303(2), 352, 351(3), 3(5) of the BNS, 2023.
3. As per the FIR, on 13.12.2024, in the afternoon, at about 1:00 p.m., while the informant was returning home with his sister from coaching, and no sooner than he reached near the house of petitioner no. 2, he was stopped by the petitioners and other accused persons. The accused co-accused Rajesh Singh started abusing him, and upon order of Rajesh Singh, the
Patna High Court CR. MISC. No.25587 of 2025(2) dt.07-05-2025 2/3 petitioner no. 2 inflicted knife blow upon the informant due to which he sustained injury near his head and neck. It has further been alleged that co-accused Rajesh Singh and petitioner no. 1, assaulted the informant by fist and slap. When the mother of the informant intervened, she was assaulted by Rajesh Singh by way of lathi. The other accused persons tore the blouse of informant's mother.
4. Learned Counsel for the petitioners submits that petitioners have falsely been implicated in this case due to dispute regarding watering of wheat crop. Both the parties are agnates. A counter case has been lodged by the side of the petitioners bearing Kateya P.S. Case No. 510 of 2024. The injuries caused to the informant and others are simple in nature as would be evident from the injury report annexed at Annexure P/4 and P/5. The side of the informant has also sustained injuries as would be evident from the injury report annexed at Annexure P/3.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having dispute regarding land, case and counter case has been filed by both the parties, the injuries sustained by the informant and side of the petitioners are simple
Patna High Court CR. MISC. No.25587 of 2025(2) dt.07-05-2025 3/3 in nature, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Gopalganj, in connection with Kateya Police Station Case No. 487 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
