JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Nokha P.S.Case No. 299 of 2017 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 353, 436, 427, 504, 153A, 295A and 505C of the Indian Penal Code.
Allegation against large number of accused persons, including the petitioner is of creating obstruction and disturbing breach of peace during emersion of Durga idol. Submission of learned counsel for the petitioner is that no specific allegation is attributed against the petitioner and 92 persons have been made accused in this case and other co-accused have been granted privilege of anticipatory by in Cr.Misc.No. 56358 of 2017, vide order dated 29.11.2017 and in Cr.Misc.No.1770 of 2018, vide order dated 12.1.2018 and the case
Patna High Court Cr.Misc. No.4007 of 2018 (2) dt.01-02-2018 2/2 of petitioner stands on similar footing.

In the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 299 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which his bail bond shall be cancelled.
