The present contempt petition is for non compliance of the order dated 29.01.2022 passed in C.W.J.C. No. 3433 of 2021. The second respondent who is suspending authority to the petitioner has not complied the order of this Court on the score that he would be completing disciplinary proceedings initiated against the petitioner and he has completed in imposition of

Patna High Court MJC No.816 of 2022(5) dt.22-09-2022 2/2 penalty of dismissal from service on 30.03.2022. At the same time, he has failed to file review petition to recall the order to the extent of granting two months time or to modify paragraph 8 of the order.

Today, he has instructed his counsel stating that review of suspension would be undertaken. It is astonished to note that review of suspension would be undertaken after passing dismissal order on 30.03.2022. Having regard to the fact that petitioner has been dismissed from service on 30.03.2022, question of review of suspension is not warranted. However, for non-compliance of the order dated 29.01.2022 passed in C.W.J.C. No. 3433 of 2021, second respondent is hereby directed to pay cost of Rs. 5,000/- (Rupees Five Thousand) from his pocket in the Patna High Court Legal Services Committee, Patna High Court within a period of four weeks from today. Accordingly, present contempt petition stands dropped.
