Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-04-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is one of the accused who had fired at the deceased. The petitioner is in custody since 02.02.2018. In the past prayer for bail was refused on 19.06.2019 vide order at Annexure-2 with direction to the learned trial Judge to conclude the trial within nine months. The report of the trial Judge would reveal that charges have been framed in February, 2021. Petitioner is ready to cooperate with the trial.

Considering entire facts of this case aforesaid as well as the fact that there is no need for further detention of the

No.23693 of 2020(4) dt.07-04-2021 2/2 petitioner as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Phulwari Sharif P.S. Case No.29 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
