====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Ram Shankar Das, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Special Case No.1869/17 arising out of Kadamkuan P.S. Case No.206 of 2017 registered for the offence under Section 30/38 of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail, in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that nothing was recovered from the conscious possession of the petitioner, rather in this case recovery of Indian Make Foreign liquor was shown from the house of one Bimlesh Singh and the petitioner's name has come only on suspicion, whereas the petitioner is having clean antecedent. This fact has been mentioned in paragraph-3 of the petition.

No.46809 of 2017(2) dt.17-10-2017 2/2 Considering the nature of accusation, clean antecedent as well as the fact that nothing was recovered from the conscious possession of the petitioner and his name has come only on suspicion, let the petitioner, namely Manna Sahni be released on bail, in the event of his arrest or surrender within six weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge VIIIcum- Special Judge, Excise, Patna in connection with Special Case No.1869/2017 arising out of Kadamkuan P.S. Case No.206 of 2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
