====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 04-07-2025 Heard Mr. Jay Ram Prasad, learned counsel for the petitioner, Mr. Choubey Jawahar, learned APP for the State as also Ms. Mickey Singh, learned counsel for the Informant.

2. The petitioner seeks bail in connection with Fatuha P.S. Case No. 829 of 2023 instituted for the offences under Sections 341, 307, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act in which charge-sheet has been submitted under Sections 341, 302, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Prosecution case, in short, is that this petitioner along with other co-accused persons fired upon the informant's son as a result of which he sustained injuries and, later on, died.

4. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected by this Court on merit vide order dated 18.09.2024 passed in Cr. Misc. No. 47944 of 2024.

5. In compliance to the earlier order of this Court dated 25.04.2025, a report dated 24th May, 2025 with regard to present stage of trial has been received which has been kept at Flag- 'A'.

6. From perusal of the aforesaid report dated 24th May, 2025 sent by learned District & Additional Sessions Judge-V, Civil Court, Patna City, it appears that the charges hacw been framed on 10.02.2025 under Sections 341, 302, 307/34 of the I.P.C. and summons to the witnesses were issued on 30.04.2025 but, no any prosecution witness was examined till today and total number of charge-sheeted witnesses to be examined are six. It is further stated that the trial is expected to be concluded within six months.

7. Learned counsel for the Informant submits that out of total six witnesses, three witnesses have already been examined and the next date is fixed on 08.07.2025.

8. Having heard learned counsel for the parties, this Court does not find any new/fresh ground for considering the the prayer for grant of bail to the petitioner.

9. Accordingly, the prayer for bail of the petitioner is again rejected with a direction to the learned court below to expedite the trial and concluded the same expeditiously. (Rudra Prakash Mishra, J) rishi/- U T
