The petitioners seek anticipatory bail in a case instituted for the offence under Sections 365 and 385 of the Indian Penal Code.
It is alleged in the written report that minor daughter of the informant has been kidnapped by Sanni Rajak and his other family members as named in the written report. It has been submitted on behalf of the petitioners that the girl with her consent has already performed marriage with Sanni Rajak and she is living with him. It has further been submitted that in paragraph 31 of the case diary the police in the
Patna High Court Cr.Misc. No.46767 of 2016 (5) dt.31-01-2017 2/2 supervision note has mentioned that the victim girl sent a message to the Senior Superintendent of Police that she is living with Sanni Rajak in Bangalore and is well. The petitioners are family members of Sanni Rajak. There are no specific allegations against these petitioners.
Considering the aforesaid facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Kahalgaon N.T.P.C. P.S. Case No. 21 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
