====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Mahua P. S. Case No.20 of 2021, instituted for the offences under Sections 30(a), 32(ii), 34(ii), 38(ii) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.03.2021, charge-sheet has been submitted in this case and he has one antecedent. Allegation is of recovery of 1023.34 litres of Indian made foreign liquor from a place which is opposite the premises of government school.

The learned counsel for the petitioner submits that the petitioner was not apprehended at the place of occurrence rather

Learned counsel further submits that petitioner has been falsely implicated in this case as he was not present when the liquor was recovered.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 20.03.2021, charge-sheet has been submitted in this case and he has one antecedent, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Mahua P. S. Case No.20 of 2021. The application stands allowed.
