This Criminal Revision is directed against the Judgment dated 13.11.2007 passed in Criminal Appeal No. 10 of 2007 dismissing the aforesaid Criminal Appeal preferred by the petitioner against the order dated 20.12.2006 rejecting the application of the petitioner filed under Section 456 (1) Cr.P.C. to restore the possession of the land after conviction of O.P. No.2 to 6 in C.R. No. 94 of 1991 by the Court of Sri R.K.
Patna High Court CR. REV. No.368 of 2008 dt.13-09-2019 2/2 Srivastava, J.M. 1st Class, Darbhanga on 25.04.2004 arriving at conclusion that Miscellaneous Case No. 113 of 2005 was filed by the petitioner/appellant after more than one month, while as per provision of Section 456(1) of Cr.P.C. the application may be filed within one month of the Judgment of conviction. On going through the impugned Judgment/order, I find no illegality in the impugned Judgment/order. Hence this criminal revision is dismissed.
