The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/323/325/354/379/504/34 of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the petitioner submits that there is case and counter case between the parties with regard to the cutting of earth by the informant's side in lands belonging to the petitioner. It is submitted that the allegations with regard to the offence under Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 are being brought in only to make the charge grievous.

No.58427 of 2015 (2) dt.22-01-2016 P2/2 Considering the aforementioned facts and circumstances and that there is land dispute between the parties and there is case and counter case and also the fact that the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Parihar P.S. Case No. 250/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
