JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-04-2018 Learned counsel for the petitioner is permitted to make necessary correction in paragraph-1 of the petition. Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Forbesganj P.S. Case No.825 of 2017 registered under Sections 147, 341, 323, 354-B, 427, 504 and 506 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that save and except Section 354-B of the Indian Penal Code all other Sections are bailable in nature. He submitted that there is case and counter case. In the counter case, vide Forbesganj P.S. Case No.826 of 2017 it has alleged by the petitioner that the informant assaulted and took away rupees three lacs and one

He submitted that for the injury caused to the petitioner he was taken to the referral hospital On the other hand, learned counsel for the State submitted that there is allegation that the petitioner teased grand daughter of the informant and on protest he abused and quarrelled with his family members.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner, who is said to be a young boy aged 22 years only having no criminal antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.825 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
