The petitioners, namely, Pankaj Kumar and Guddu Kumar, apprehend their arrest in Kawakol P.S. Case No. 97/15 registered under Section 307 and other sections of the Indian Penal Code.
The informant named the petitioners Pankaj Kumar and Guddu Kumar and alleged that Pankaj Kumar and Sonu Kumar assaulted her mother with Tangi on her head and hand. When the informant went to save her mother, the petitioners caught her dupatta with an intention to outrage her modesty. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the case. The injury found on the person of the father of the informant is simple in
Patna High Court Cr.Misc. No.41236 of 2016 (2) dt.17-10-2016 2/2 nature. The mother of the informant, of course, got three injuries but only one injury found on her right middle finger is opined to be grievous.
Considering the facts that there is specific allegation against the petitioners that the petitioners not only assaulted the mother of the informant but also made an attempt to outrage the modesty of the informant and the mother of the informant got fracture injury on her finger, I am not inclined to enlarge the petitioners on anticipatory bail in Kawakol P.S. Case No. 97 of 2015. Accordingly, the same is rejected.
