The petitioners apprehend their arrest in connection with Narhat (Sitamarhi) P.S. Case No. 146 of 2016 registered under Sections 147, 353, 307, 427 and 504 of the Indian Penal Code.
The allegation against the petitioners is that during the course of distribution of B.P.L. coupon, the petitioners along with two others created nuisance and also made attempt to kill the informant.
Learned counsel appearing on behalf of the petitioners submits that petitioners have no criminal antecedent and have falsely been implicated in this case. From perusal of the
Patna High Court Cr.Misc. No.214 of 2017 (2) dt.10-01-2017 2/2 F.I.R., it is apparent that neither petitioners have taken attempt to kill anyone nor anyone sustained injury during the course of distribution of B.P.L. coupon.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-III, Nawada in connection with Narhat (Sitamarhi) P.S. Case No. 146 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shail/- U T
