Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 34 of the Indian Penal Code.

As per the prosecution case, on 11.02.2022 at 8 Pm one co-accused Raj Kumar had called the husband of the informant to meet and on next morning dead body of the husband of the informant was found lying in the field full of water. It is further alleged that informant suspects all the accused persons including this petitioner have committed

Patna High Court CR. MISC. No.27522 of 2023(2) dt.11-07-2023 2/3 murder of the husband of the informant.

It is submitted that petitioner is a labour and he has ben implicated in this case only on suspicion. Informant is not an eye witness. There is no specific allegation against the petitioner. The name of the petitioner transpired during the course of investigation beacause tower location of mobile of this petitioner was found near the place of occurrence. Except suspicion there is no direct and circumstantial evidence to connect the petitioner with the alleged crime. Petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Samastipur, District-Samastipur in connection with Musrigharari P.S. case no 26 of 2022, subject to the conditions laid down under section 438(2) of the Code of
