2. The petitioners seek bail in connection with Akodhigola P.S. Case No. 400 of 2025, instituted for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 109, 308(2), 308(3), 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and read with Section 27 of the Arms Act.

3. The prosecution case, in short, is that the petitioners along with other co-accused persons are alleged to have surrounded the informant, abused him and shot fire on him due to which the informant became unconscious.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Learned counsel for the petitioners also submits that there is no any eye witness of the alleged occurrence. No specific allegation has been attributed against the petitioners. The petitioners are in custody since 31.10.2025. Petitioner in Cr. Misc. No. 25869 of 2026 bears four criminal antecedent and petitioner in Cr. Misc. No. 27039 of 2026 bears two criminal antecedents.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of

Patna High Court CR. MISC. No.25869 of 2026(4) dt.20-07-2026 3/3 bail to the petitioners. Learned counsel for the informant submits that there is specific allegation levelled against the petitioners. It is further submitted that the trial is in progress and three witnesses have already been examined in this case.

6. Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence and present stage of the case, this Court is not inclined to grant bail to the petitioners.

7. The prayer is rejected. The trial Court is directed to expedite the Trial. However, if the trial is not concluded within a period of fours months from the date of receipt/production, the petitioners will have liberty to renew their prayer for bail in the Court below.
