Petitioner apprehends his arrest in a case registered for the offence punishable under Section 364, 34, 302 and 201 of the Indian Penal Code.

As per the prosecution case, on 21.12.2020 at about 8:00 PM the Devar of the informant was abducted by some unknown miscreants. It is further alleged that one day, prior to the occurrence, this petitioner had threatened the deceased to kill him because he has given his name as witness in a case. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.27155 of 2022(2) dt.22-09-2022 2/2 prayer for anticipatory bail and submits that petitioner is named in the FIR and there is specific accusation against him that one day, prior to the occurrence, this petitioner had threatened the deceased to kill him because he became witness in a case against him.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
