Through this writ application, the petitioner seeks direction to the respondents to remove encroachment from the public road of khesra no.415 appertaining to khata no.148 of Mauza Ghuguldih, P.S. Barhat, District, Jamui which stands described in the revenue records as Survey Sadak.
This writ application has been filed without impleading the encroachers. However, a counter affidavit has been filed and it has been stated in paragraph no.6 that encroachment case no.1/13 has already been initiated against certain encroachers. In paragraph no.7,

Accordingly, this writ application stands disposed of with a direction to the respondent no.4, the Circle Officer, Barhat, without going into the merit of the case, to bring the encroachment case no.1/13 to its logical conclusion within a period of two months from the date of receipt/production of a copy of this order. It is made clear that the final order should only be passed after hearing all the persons including the encroachers, if the same has already not been done.
