JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-11-2017 Heard learned Counsel for the petitioner, learned Counsel appearing on behalf of Opposite Party No. 2 and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Sachiwalay Police Station Case No. 131 of 2014, disclosing offences under Sections 409/420/467/468/471/120B/34 of the Indian Penal Code.

A committee was constituted to enquire into the allegation of manipulation in electric meters/bills. The committee found one Vishal Kumar to be involved in such illegal activities in connivance with the officials/employees of the South Bihar Power Distribution Company Limited.

Patna High Court Cr.Misc. No.48773 of 2017(2) dt.14-11-2017 2/3 Learned Counsel appearing on behalf of the petitioner has submitted that the said Vishal Kumar has disclosed the name of the present petitioner and one Yatindra Kumar and except that there is no other material against the petitioner. He submits that the main accused, Vishal Kumar, has been granted regular bail and co-accused Yatindra Kumar has been granted anticipatory bail by the Court below.

Considering the above submission, this application is allowed.

Let the petitioner, Madhuranjan @ Manoranjan, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Rupa Kumari, Judicial Magistrate, 1st Class, Patna, in connection with Sachiwalay Police Station Case No. 131 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail

Patna High Court Cr.Misc. No.48773 of 2017(2) dt.14-11-2017 3/3 bond shall be liable to be cancelled.
